Terms of Service

1. Acceptance

By creating an account or using Big Small Farm ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

Big Small Farm is a property and workforce management platform for rural and lifestyle blocks. It provides task management, property mapping, team collaboration, emergency alerts, and related tools. The Service is provided by Rabbit Hawk Limited, New Zealand.

3. Accounts

You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use the Service.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Misuse the Danger Mode or Critical Alert features (e.g., false panic alerts).
Attempt to gain unauthorised access to other users' data or properties.
Upload malicious content or interfere with the Service's operation.
Use the Service to harass, threaten, or intimidate any person.
Use the Service to coordinate, facilitate, or conceal illegal activity.
Create accounts or properties for fraudulent purposes.

5. Platform Monitoring & Oversight

To protect the safety, security, and integrity of the Service and its users, Rabbit Hawk Limited reserves the right to:

Monitor for illegal activity or misuse: We may review account activity, property data, task records, and usage patterns to detect violations of these Terms, applicable law, or conduct that endangers the safety of users or the public.
Investigate reports: When abuse, misuse, or safety concerns are reported — by users, law enforcement, or automated systems — we may access relevant account and property data to investigate.
Suspend or terminate accounts: We may immediately suspend or permanently terminate accounts that violate these Terms, engage in illegal activity, misuse safety features, or pose a risk to other users. We will endeavour to provide notice where practicable, but reserve the right to act without prior notice in urgent safety or legal situations.
Access data for legal compliance: We may access, preserve, and disclose account information and content when required by law, subpoena, court order, or valid law enforcement request, or when we believe in good faith that disclosure is necessary to prevent imminent harm, protect our legal rights, or respond to a safety emergency.
Cooperate with authorities: We may cooperate with law enforcement agencies, regulatory bodies, and emergency services in connection with investigations of illegal activity, safety threats, or misuse of the Service.

Platform oversight is carried out by authorised administrators only, limited to the minimum access necessary, and conducted in accordance with our Privacy Policy and applicable New Zealand law, including the Privacy Act 2020.

6. Your Content

You retain ownership of all content you create (tasks, photos, videos, documents). By uploading content, you grant us a limited licence to store, process, and display it as necessary to provide the Service. We do not use your content for advertising or sell it to third parties.

7. Emergency Features

Danger Mode and hazard alerts are designed to assist with on-property safety communication. They are not a substitute for emergency services. In a life-threatening emergency, always call 111 (NZ) or your local emergency number first. We do not guarantee delivery or timing of any notification.

8. Location Sharing

Certain features (task pinning, live map, Danger Mode) use your device's location. By enabling these features, you consent to sharing your location with members of your property team. Background location is only collected during active Danger Mode sessions.

9. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes at any time.

10. Intellectual Property

The Big Small Farm name, logo, and application code are owned by Rabbit Hawk Limited. You may not copy, modify, or redistribute the application.

11. Limitation of Liability

To the maximum extent permitted by New Zealand law, Rabbit Hawk Limited is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to failure of emergency notifications to deliver.

12. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, as described in Section 5.

13. Governing Law

These Terms are governed by the laws of New Zealand. Disputes will be resolved in New Zealand courts.

14. Changes

We may update these Terms. Continued use after changes constitutes acceptance.
